Islamabad court grants relief to Malabar group in a trademark dispute with a local jeweller, Retail News, ET Retail

The district court in Islamabad, Pakistan has ordered the arrest of a local jeweller for allegedly using the Malabar logo and restricted him from using the brand till further order.

The court issued the arrest order as the jeweller Mohammad Faizan failed to comply with an earlier order that had directed him to stop the use of the identical logo and the tagline ‘Celebrate the beauty of Life’, allegedly identical to Indian jewellery firm Malabar Gold (Pvt) Ltd.

“The respondent has been repeatedly served through notice and bailable warrants but he did not appear for the court…” observed district judge Dr Rasool Bukhsh Mirjat in his order of December 14. “…he assured the bailiff to arrange a surety, but he has failed to do so, therefore, he is remanded to judicial custody for want of surety of the bonds and be produced for framing of charges.”

In this case, Malabar Group initially filed a petition in June 2021, after noticing the infringement of its trade name and logo by one Muhammad Faizan of Islamabad who purportedly run a jewellery store with the same trade name and logo.

The district judge of Islamabad East, after taking cognition of the crime and accepting the petition, on June 7, 2022, ordered the local jeweller not to use the logo or trade name till the final verdict in the case.

However, the Kochi-headquartered group found that the Islamabad-based jeweller violated the court order by continuously using the same trademark and logo.

Subsequently, Malabar Gold approached the court against the continued violation of the order and sought to frame willful contempt of the court charges against the owner of the Pak entity, and prayed for continued enforcement of the earlier order to restrict him from using the logo.

According to the company’s website, Malabar Gold & Diamond is the flagship company of the Malabar group and currently, it has over 285 outlets spread across 10 countries.
